Petabox™ Website Terms of Use

These Terms of Use (the "Terms") govern your access to and use of the website at https://petabox.io and its subdomains (the "Website"), operated by Lendeco Ltd, a company incorporated in the Republic of Cyprus with its registered office at Aiolou & Panagioti Diomidous 9, Katholiki, 3020 Limassol, Cyprus, trading as Petabox ("Petabox", "we", "us"). By using the Website you agree to these Terms. If you do not agree, please do not use the Website.
1. Scope
1.1 These Terms apply to the Website only: its pages, documentation, downloads made available on it, and the contact form. 1.2 The Petabox software, managed services, and professional services are provided under a separate Master Services Agreement and the Order Forms signed under it. Nothing on the Website constitutes an offer, a quotation, or a binding commitment to provide software or services. Specifications, capacities, and performance figures shown on the Website are illustrative and may differ from what is agreed in an Order Form.
2. Use of the Website
2.1 You may use the Website for lawful purposes and in accordance with these Terms. 2.2 You must not: (a) access, probe, or test the security of the Website or any system connected to it without our written permission; (b) use automated tools to scrape or download Website content beyond what search engines ordinarily do; (c) upload or transmit malicious code; (d) use the Website to send unsolicited communications; (e) impersonate any person or misrepresent your affiliation; or (f) interfere with the operation of the Website or other users' access to it. 2.3 We may suspend or restrict access to the Website, in whole or in part, at any time and without notice, for maintenance, security, or any other reason.
3. Contact form and communications
3.1 When you submit the contact form, you confirm that the information you provide is accurate and that you are authorised to provide it on behalf of your organisation, where applicable. 3.2 We process the information you submit in accordance with our Privacy Policy. Submitting the form does not create a contract between you and Petabox. 3.3 Communications made through the Website or by email are not confidential unless a non-disclosure agreement is in place. If you need to share confidential information before an NDA is signed, please say so in your message and we will arrange one first.
4. Intellectual property
4.1 The Website and its content — text, graphics, logos, images, screenshots, documentation, and software — are owned by Petabox or its licensors and are protected by copyright, trademark, and other laws. "Petabox" and the Petabox logo are trademarks of Lendeco Ltd. 4.2 You may view, download, and print Website content for your own internal evaluation of Petabox products and services. Any other use, including reproduction, modification, distribution, or public display, requires our prior written consent. 4.3 Third-party names and logos shown on the Website (including ClickHouse, PostgreSQL, Kafka, Elasticsearch, Ceph, Prometheus, Grafana, and others) are trademarks of their respective owners. Their appearance indicates that Petabox works with those technologies; it does not imply endorsement by or affiliation with their owners.
5. Documentation and downloads
5.1 Documentation at https://docs.petabox.io is provided for information. It may be updated without notice and may describe features not available in every version or configuration. 5.2 Any software, scripts, or configuration files made available for download on the Website are provided under the license terms stated with them. In the absence of stated terms, they are provided for evaluation only and remain the property of Petabox.
6. Third-party links
The Website may contain links to third-party websites. We do not control them and are not responsible for their content, availability, or privacy practices. A link does not imply endorsement.
7. Disclaimer
7.1 The Website is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or free of harmful components, or that its content is complete, accurate, or current. 7.2 Nothing on the Website is professional, legal, or technical advice for your specific situation. Decisions about infrastructure, data location, compliance, and migration should be based on an assessment of your own requirements, which we are happy to help with under an Order Form.
8. Limitation of liability
8.1 To the fullest extent permitted by law, Petabox is not liable for any loss or damage arising from your use of, or inability to use, the Website or its content, including indirect, incidental, or consequential loss and loss of data or profit. 8.2 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law. 8.3 Liability in connection with the software and services themselves is governed by the Master Services Agreement, not by these Terms.
9. Privacy and cookies
Our Privacy Policy explains what personal data we collect through the Website and how we use it. Our Cookie Policy explains which cookies the Website uses. Both form part of these Terms.
10. Changes
We may update these Terms from time to time. The current version is always published on the Website with its effective date. Changes apply from the date of publication; your continued use of the Website after that date constitutes acceptance.
11. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Cyprus. The courts of Limassol, Cyprus have exclusive jurisdiction over any dispute arising out of or in connection with them, except that where you are a consumer, you retain any mandatory rights under the law of your country of residence.
